Terms & Conditions

These Terms and Conditions (“Terms”) govern your use of Click Fused’s website at clickfused.com and all services offered by Click Fused, including but not limited to digital marketing, SEO, web development, content strategy, paid advertising, and analytics consulting.

By accessing our website, submitting an enquiry, signing a service agreement, or engaging us in any capacity, you agree to be bound by these Terms.

Click Fused is a full-service digital marketing agency. Our services include, but are not limited to:

Specific deliverables, timelines, and scope are defined in the individual Service Agreement or Proposal signed by the client.

Client Responsibilities

For Click Fused to deliver effective services, clients agree to:

Provide accurate, complete, and up-to-date business information, brand assets, and content access as required
Designate a primary point of contact for communications and approvals
Review and approve deliverables within the agreed timeframe (default: 5 business days)
Grant necessary access to platforms, tools, and accounts required for the engagement (e.g., Google Analytics, Search Console, social media pages)
Ensure all content, assets, or materials provided to Click Fused do not infringe third-party intellectual property rights
Communicate delays, changes in business direction, or scope changes promptly
Make timely payments as per the agreed schedule

Project Delays

Delays caused by client non-response, late approvals, or incomplete information provision are not the responsibility of Click Fused and will not affect agreed fee structures.

Pricing & Payment Terms

All fees are quoted in Indian Rupees (INR) unless otherwise agreed, inclusive of applicable GST
Payment is due as per the schedule in the signed Proposal or Service Agreement
Standard terms: 50% advance before project commencement, 50% upon completion (or as per agreed milestones)
Monthly retainer clients are billed at the start of each month
Invoices are payable within 7 days of issue unless otherwise agreed in writing
Late payments beyond 14 days may attract a 2% per month late fee
Persistent non-payment may result in suspension of services without liability on Click Fused’s part
All ad spend for paid campaigns is billed separately and directly to the client’s ad account unless a management-plus-spend model is agreed

Cancellation & Refunds

Scenario	Refund
Project cancelled before work begins (7+ days before start)	100% refund of advance (less processing fee of ₹500)
Project cancelled 3–6 days before start	75% refund of advance
Project cancelled after work has commenced	Refund for unbilled work only, at Click Fused’s discretion
Monthly retainer cancelled mid-month	No refund for the current month; services continue until month end
Service cancelled due to Click Fused’s inability to deliver	Full refund of advance paid for undelivered work

Refund requests must be submitted in writing to support@clickfused.com
Approved refunds are processed within 7–10 business days to the original payment method
Ad spend already deployed is non-refundable

AI-Assisted Content Disclaimer

Click Fused uses AI tools including ChatGPT, Claude, Gemini, and Perplexity to assist in producing website content such as blog posts, service descriptions, comparisons, reviews, site copy, brand references, and other materials.

By using our website, you acknowledge and agree that:

Some content on this site has been drafted or researched with AI assistance and reviewed by the Click Fused team
References to third-party tools, brands, or institutions are for informational purposes only
Click Fused does not claim affiliation with any third-party brands unless explicitly stated
Third-party logos or trademarks belong to their respective owners
AI-assisted client deliverables are clearly communicated and reviewed before delivery

Content Removal Requests

If any content inaccurately represents your brand or needs removal, contact support@clickfused.com. We respond within 7 business days and act within 14 business days if the request is valid.

IP Ownership

Client Ownership

Upon full payment, clients own all final deliverables created specifically for their project (website, content, creatives)
Ownership transfers only after all outstanding invoices are settled

Click Fused Ownership

Click Fused retains ownership of all proprietary methodologies, templates, frameworks, and internal tools used in service delivery
All website content on clickfused.com — including blog posts, copy, graphics, and design — remains the intellectual property of Click Fused
You may not reproduce, distribute, or use our website content without written permission

Third-Party Assets

Any third-party assets (stock photos, fonts, plugins) used in deliverables are licensed appropriately and disclosed to clients
Clients are responsible for obtaining any additional licences they require beyond the project scope

Confidentiality & NDAs

Both parties agree to maintain confidentiality of proprietary information shared during the engagement:

Click Fused will not disclose client business strategies, data, or trade secrets to third parties without consent
We may reference the client relationship in our portfolio unless a written no-disclosure request is made
Clients must not disclose Click Fused’s proprietary processes, pricing structures, or internal tools
A formal Non-Disclosure Agreement (NDA) can be signed upon request at no additional cost

Performance & Results Disclaimer

Digital marketing results depend on numerous external factors outside Click Fused’s control. Therefore:

We do not guarantee specific search engine rankings, traffic volumes, conversion rates, or revenue outcomes
SEO results typically take 3–6 months and depend on competition, algorithm changes, and client website quality
Paid campaign ROI is influenced by industry, budget, creative quality, and market conditions
Any projections or case studies presented are illustrative of past results and not guarantees of future performance
Google, Meta, and other platform algorithm changes are outside our control and may affect campaign performance

Our Commitment

While we cannot guarantee specific outcomes, we are committed to applying best-practice strategies, transparent reporting, and proactive communication to maximise your results.

Limitation of Liability

Click Fused’s total liability to any client shall not exceed the total fees paid for the specific service giving rise to the claim
We are not liable for indirect, consequential, incidental, or punitive damages arising from use of our services
We are not liable for losses resulting from third-party platform changes, outages, or policy updates (Google, Meta, etc.)
We are not liable for any damage resulting from client-provided content, assets, or incorrect information
Website content at clickfused.com is for informational purposes only and does not constitute professional legal, financial, or technical advice

Governing Law & Disputes

These Terms are governed by the laws of India, with jurisdiction in the courts of Tamil Nadu.

Any dispute will first be attempted to be resolved amicably through direct communication within 30 days of the issue arising
If unresolved, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996
The seat of arbitration shall be Tamil Nadu, India; the language shall be English
Both parties agree to exhaust internal resolution before pursuing formal legal action
